BRINGING A CLAIM

Specifically, the victim must prove that the property owner created the unsafe condition that caused the accident, or failed to maintain the property, and knew or should have known of the hazard but did not provide warning to those legally using the property. Also, special rules exist for property owned or leased by units of local government.
